1. Description of Services

Americana Management LLC provides AI-assisted communication and business support services, including but not limited to:

  • AI-powered call answering and receptionist services

  • Call recording, transcription, and summaries

  • SMS, email, and messaging support

  • Appointment scheduling and integrations

  • Reporting and communication management tools

Services may include automated and artificial intelligence (“AI”) components.

2. Use of Services

By using our services, you agree to:

  • Use services only for lawful business purposes

  • Not use services for spam, harassment, or illegal activity

  • Provide accurate account and contact information

You are responsible for all activity conducted through your account.

3. AI Services Disclaimer

You acknowledge that:

  • Some services are powered by AI systems

  • AI-generated responses, transcripts, and summaries may contain inaccuracies

  • You are responsible for reviewing and verifying important communications

Americana Management LLC does not guarantee accuracy of AI-generated outputs.

4. Call Recording & Communication Consent

By using our services, you agree that:

  • Calls may be recorded and transcribed

  • Messages (SMS, email, voicemail) may be stored and processed

  • You are responsible for complying with all applicable call recording and consent laws in your jurisdiction

5. HIPAA Compliance (Optional Add-On)

HIPAA-compliant services are only provided if:

  • The HIPAA add-on is purchased

  • Proper configurations are implemented

  • A Business Associate Agreement (BAA) is executed where required

Without these steps, services are not guaranteed to meet HIPAA compliance standards.

6. Billing & Subscription Terms

  • Services are billed on a monthly subscription basis

  • All plans renew automatically unless canceled

  • You may cancel at any time before the next billing cycle

  • No partial refunds are guaranteed unless stated otherwise

Failure to pay may result in suspension or termination of services.

7. Limitation of Liability

To the fullest extent permitted by law:

Americana Management LLC shall not be liable for:

  • Missed calls or messages

  • AI errors or inaccuracies

  • Scheduling conflicts or failures

  • Business losses, lost revenue, or damages resulting from service use

Services are provided “as is” without warranties of any kind.

8. Data Responsibility

  • You retain ownership of your data

  • You grant us permission to process data to deliver services

  • You are responsible for ensuring lawful data collection and use

9. Acceptable Use Restrictions

You may not use our services for:

  • Illegal activities

  • Harassment or abusive communications

  • Fraudulent or misleading purposes

We reserve the right to suspend accounts violating these terms.

10. Termination

We may suspend or terminate services if:

  • Terms are violated

  • Payment is not received

  • Use presents legal or operational risk

11. Modifications

We may update these Terms at any time. Continued use of services constitutes acceptance of updated terms.
